Privacy policy

AM Smart Sp. z o.o. headquatered in Poznań, ul. Kaliska 21, 61-131 Poznań, processes personal data on the basis of consent given by the data subject ( i.e. on the basis of Article 6 (1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter RODO). At the same time, it is stipulated that AM Smart Sp. z o.o. is alsko entitled to process personal data in order to project its legitimate interests when the interest, i.e. on the basis of Article 6(1)(f) of the RODO. AM Smart Sp. z o.o. will process the personal data for the duration of the use of the Websites by the data subject, or until the erasure of the collected personal data is requested. This Policy applies to the websites, in the terms of "cookies", as well as other similar technologies for recording information concerning the Users, (hereinafter: "the Websites") of which AM Smart Sp. z o.o. with its registered office in Poznań is the operator and guarantees the Users of the operator's websites the right to choose in terms of providing information concerning him/her.

Rights of the data subject

The person whose personal data is processed by AM Smart Sp. z o.o. has the rights to:

• access to the personal data processed by AM Smart Sp. z o.o. together with the information indicated in Article 15(1) of the RODO, also contained in this privacy policy. At the same time, the person has the right to request a copy of his/her personal data subject to processing;

• to have inaccurate of incompete personal data rectified without delay, if the data is contrary to its actual form of incomplete;

• request erasure of the data (right to be forgotten ) when:

           • the data are no longer necessary for the purposes that form the basis of processing;

           • the consent forming the basis for the processing of personal data has been withdrawn by the person concerned;

           • a legitimate objection has been lodged, as mentioned later in this policy;

           • the personal data was processed by AM Smart Sp. z o.o. unlawfully;

           • the obligation to delete personal data results from the preovisions of Community or national law;

           • consent to the processing of personal data was given by a minor, younger than 16 years of age;

• request for restriction of the processed data in a situation where:

           • the person questions the correctness if the data, or in the fact face of an objection referred to later in this privacy policy - for a period allowing AM Smart Sp. z o.o. to verify the correctness of the processed data or to recognize the legitimacy of the objection;

           • in a situation where, despite the fact rhat the data processing is contrary to the law, the data subject, instead of deleting the data, only wants limit the scope of the data in the AM Smart Sp. z o.o. filing system;

• the need to process the personal data for AM Smart Sp. z o.o. has ceased, but the data subject needs further processing for the purposes of establishing, asserting or defending his/her claims;

• during the period of restriction of processing AM Smart Sp. z o.o. is entitled to store the data and processing is only possible with the consent of the data subject, or the purpose of establishing, asserting or defending claims, or the protection of the rights of another individual or legal person, or for compelling reasons of public interest of the Union or Member State;

• to issue to it those personal data that it has provided to the controller, in a structured, commonly used machine-readable format. The data may be released directly to the controller designated by the data subject, when this is technically possible;

Refusal of the aforementioned request by AM Smart Sp. z o.o. must be justified by the provisions of generally applicable law, in particular the RODO.

Objection

The data subject has the right to object to the processing of his/her personal data based on Article 6(1)(e) or (f), including profiling under these provisions.

In an objection is raised, AM Smart Sp. z o.o. will immediately restrict the processing of personal data on the basis of the principles set forth in the previous section.

Subsequently, in the case of the legitimate nature of the objection, the personal data will be delated by AM Smart Sp. z o.o., unless valid, legitimate grounds, overriding the interests, rights and freedoms of the data subject, or the data provide a basis for establishing, asserting or defending claims, are behind its further processing for purposes other than marketing. What are "cookies" files?

By "cookies" we mean short text-number information recorded on the device through which a person browses the website, computer data, in particular text files, stored in the users terminal devices ( including computers, laptops, smartphones, tablets) intended for use on the website. These files allow to recognize the users device and appropriately display the website tailored to his individual preferences. "Cookies" usually contain the name of the website they come from, the time they are stored on the end device and a unique number. "Cookies" do not have any effect on the software on the end users device. "Cookies" from the operator's website can only be read by the operator.

What do we use "cookies" for?

"Cookies" are used to adapt the content of the websites to the user's preferences and expectations and to optimize the use of the websites. They are also used to create anonymous, aggregate statistics that help to understand how to user uses the websites to improve theirs structure and content, excluding the personal identification of the user. Thanks to " cookies" we check performance, analyze and study how our websites work by creating anonymous statistcs, which allows to improve their structure and content. Do the "cookies" files contain data identifying the User's identity? Personally identifiable data collecting using "cookies" may be collected for the sole purpose of performing certain function for the user. Such data are encrypted in a way that prevents unauthorized access. We never identify the identity of users on the basis of information provided by "cookies". Operational data collected using "cookies" may also be collated with demographic data (e.g. age, gender, size of locality) provided by Users given at registration. In this case, the collated data are deprived of any markings identifying the User ( anonymization). The achieve the purposes indicated above, the operator may cooperate with business partners, e.g. advertisers, research companies, application providers.

Types of "cookies" used on the operator's websites:

We use two types of cookies - session and permanent. Session cookies remain on the User's device only when using the operator's websites. On the other hand, persistent cookies remain on the User's device as long as they have a set lifespan or until they are deleted by the User. As far as the types of "cookies" are concerned, the operator uses, among others"

      • "cookies" necessary for the proper functioning of the site, so called - necessary  "cookies"  for the proper functioning of the site, so called "essential" - they allow the User to freely negative the Operator's website and use the various elements;

      • "cookies" improving efficiency, so called efficiency "coockies" - collect informations about the User's use of the operator's website, by identyfying the areas which the User has visited, the time which the User has spent on the site and the dificulties in the form of error messages;

     • "cookies" that improve the functionality - so-called functional "cookies" - remember the Users settings an choises, personalize content and service settings;

    • advertising cookies - thanks to them the User is provided with advertisements corresponding to his preferences.

Deletion of "cookies" files

By default, web browsing software allows "cookes" to be placed on the end device. If you do not want to receive "cookies", you should change the settings of your terminal device in such a way as to block the automatic handling of "cookies" in the setting of your web browser or inform about their sending each time. Detailed information about the possibility and methods of handling "cookies" is available in the settongs of the end device user's software ( web browser) or on its manufacturer's website. At the same time, we would like to inform you that limiting or disabling the use of "cookies", may affect some of the functionality available on the website and in extreme cases may prevent the use of the operator's website.

Supervisory Authority

Data subjects are also entitled to lodge a complaint with the locally competent Supervisory Authority, i.e. the President of the Office for Personal Data Protection at ul. Stawki 2; 00-193 Warszawa

 Final provisions

In matters not regulated by this privacy Policy, the provisions of generally applicable laws shall apply in particular the RODO
